Online Purchases & Optional In-Person Consultations

Introduction

These Terms & Conditions apply to all purchases made with Burghley & Co via our website. We also offer optional in-person styling consultations, which do not affect your online purchasing rights.

By placing an order with us, you agree to these Terms & Conditions.

These Terms refer to Burghley & Co Eyewear Ltd, trading as Burghley & Co, a company registered in England & Wales.

All products remain the property of Burghley & Co until paid for in full.

Products

We supply spectacle frames, sunglasses, prescription lenses, and related optical services.

Images are for illustration purposes. Colours, finishes, and materials may vary slightly due to manufacturing processes and screen display differences.

Prescription lenses and glazing services are made to your individual prescription and are therefore bespoke.

Pricing & Payment

All prices are shown in GBP (£) unless otherwise stated. Prices include VAT where applicable.

For international customers, including USA customers, approximate currency conversions may be shown for guidance only. Your payment provider may apply its own exchange rate or fees.

Payment is due in full at the time of order unless otherwise agreed in writing.

All payments are processed through secure, encrypted payment gateways.

Prices may change from time to time; however, confirmed orders will not be affected.

We reserve the right to refuse or cancel any order prior to dispatch in cases of suspected error, fraud, incorrect pricing, unauthorised activity, or where we are unable to fulfil the order.

Delivery

United Kingdom Orders

We deliver across the United Kingdom. Delivery options, costs, and estimated timeframes are shown at checkout.

Delivery times are estimates and may vary due to prescription verification, glazing times, supplier dispatch, courier performance, or circumstances beyond our control.

USA Orders

We currently ship to the 48 contiguous United States where available at checkout.

We do not currently ship to Alaska, Hawaii, Puerto Rico, Guam, the US Virgin Islands, APO/FPO/DPO addresses, or PO Boxes.

USA delivery options, costs, and estimated timeframes are shown at checkout. Delivery estimates may vary due to prescription verification, glazing, customs processing, courier delays, or other circumstances beyond our control.

Import Duties, Taxes & Customs

Where available, USA orders may be shipped on a Delivered Duty Paid (DDP) basis. This means applicable import duties and taxes are calculated and collected at checkout by the relevant checkout, tax, or shipping service.

Where DDP applies, the total shown at checkout should include applicable import duties and taxes, helping to reduce unexpected charges upon delivery.

Customs requirements, import rules, and tax calculations may vary. Burghley & Co cannot guarantee customs clearance times or be responsible for delays caused by customs authorities or courier processes.

Risk passes to you once the order has been delivered to the address provided.

In-Person Consultations

Orders placed during styling consultations may be delivered or arranged for collection by prior agreement.

Returns & Refunds

Online Orders

For eligible non-prescription frames and sunglasses purchased online, you have the right to cancel within 14 days of receipt.

Items must be returned unused, in original condition, with packaging, cases, cloths, accessories, and any included documentation.

Return postage is the responsibility of the customer unless the item is faulty, damaged, or supplied incorrectly.

This applies to both UK and USA customers. USA customers are responsible for arranging and paying for return shipping to the United Kingdom unless the item is faulty, damaged, or supplied incorrectly.

Refunds, including standard delivery where legally applicable, will be issued within 14 days of receiving the returned item or proof of posting.

A deduction may be made if items show handling beyond what is necessary to inspect them.

In-Person Purchases

Purchases made during in-person consultations are not subject to the Consumer Contracts Regulations in the same way as distance sales.

Any goodwill returns or exchanges are offered at our discretion and do not affect your statutory rights.

Prescription Lenses

Prescription lenses and bespoke glazing services are custom-made and are non-returnable unless faulty, damaged, or supplied incorrectly.

If eyewear is returned following cancellation, the frame may be refunded where eligible. Lens and glazing costs are non-refundable once completed unless faulty or otherwise covered by your statutory rights.

Minor variations in coatings, tints, colours, or finishes may fall within normal manufacturing tolerances.

If you believe there is an issue with your order, please contact us. We will review the matter and arrange a repair, remake, replacement, or refund where appropriate.

Faulty Goods

If an item arrives faulty, damaged, or incorrect, please contact us promptly.

Faults reported within 30 days may entitle you to a repair, replacement, or full refund, depending on the circumstances.

After 30 days, we will usually seek to repair or replace the item first. If this is not possible, a partial or full refund may be provided where appropriate.

We will cover reasonable return costs for faulty, damaged, or incorrect goods where agreed in advance.

Exchanges

We do not offer automatic exchanges. Eligible items may be returned for a refund and reordered separately.

Care & Warranty

Frames include the manufacturer’s warranty where applicable.

Prescription lenses include a 2-year coating warranty unless otherwise stated.

Damage caused by misuse, accidents, unauthorised adjustment, poor handling, improper cleaning, or normal wear and tear is not covered.

Prescription & Medical Disclaimer

All prescriptions must be provided by a qualified optometrist, ophthalmologist, or appropriately licensed eye care professional.

We do not provide eye tests or issue prescriptions through our website.

Prescriptions must be valid, complete, and up to date.

We may be unable to dispense eyewear where a prescription appears incomplete, unsuitable, expired, or outside our dispensing limits.

Eyewear is not a substitute for regular eye examinations or professional medical advice.

USA Customers & Insurance Documentation

For USA customers, we can provide an itemised order receipt showing relevant product and order details.

Any insurance, FSA, HSA, or reimbursement claim is the responsibility of the customer and subject to the rules of their provider.

Burghley & Co cannot guarantee reimbursement or eligibility under any health plan, insurance policy, FSA, or HSA arrangement.

Liability

Burghley & Co is not liable for indirect or consequential losses.

We are not responsible for errors resulting from incorrect, incomplete, expired, or outdated prescriptions supplied by the customer.

Nothing in these Terms limits liability where it cannot legally be excluded.

Our total liability is limited to the amount paid for the relevant product, except where the law states otherwise.

Governing Law

These Terms are governed by the laws of England & Wales.
